Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the marketing website at drawinghub.ai (the “Site”) operated by DrawingHub Pty Ltd (“DrawingHub,” “we,” “our,” or “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Scope

The Site is the marketing presence for the DrawingHub product. Use of the DrawingHub product itself (including the application, APIs, and any deliverables) is governed by a separate written agreement entered into between DrawingHub and the customer at onboarding. Nothing in these Terms grants any rights to the DrawingHub product.

2. Permitted use

You may access and view the Site for lawful, personal, and business research purposes. You agree not to:

• Scrape, mirror, or systematically download any portion of the Site beyond what a typical browser does.
• Reverse engineer, decompile, or attempt to derive the source code of any client-side code we ship.
• Probe, scan, or test the vulnerability of any system or network without prior written authorisation.
• Interfere with or disrupt the Site, including via denial-of-service or excessive automated traffic.
• Use the Site to send unsolicited messages, malware, or other harmful content.
• Misrepresent your identity or affiliation when contacting us.

Crawling by well-behaved search-engine and AI crawlers consistent with our published robots.txt is permitted.

3. Intellectual property

The Site, its content (text, images, layouts, code, logos, and trademarks including “DrawingHub”), and the underlying design are owned by DrawingHub or its licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to view the Site for the purposes set out in Section 2. All other rights are reserved.

4. Third-party links

The Site may link to third-party websites that we do not control. We are not responsible for the content, privacy practices, or availability of those sites. Following a link is at your own risk.

5. Disclaimer of warranties

The Site is provided “as is” and “as available,” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. To the extent any non-excludable consumer guarantees apply under Australian law, our liability is limited to the maximum extent permitted by that law.

6. Limitation of liability

To the maximum extent permitted by law, DrawingHub will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Site, regardless of the legal theory. Our total cumulative liability for any claim arising out of or related to the Site is limited to AUD $100.

7. Indemnification

You agree to defend, indemnify, and hold harmless DrawingHub and its officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms or your unlawful use of the Site.

8. Governing law and venue

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-laws principles. The courts of New South Wales have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Site, except where applicable consumer-protection law in your jurisdiction grants you the right to bring proceedings in your local courts.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be highlighted on the Site. Continued use of the Site after a change constitutes acceptance of the updated Terms.

10. Severability and entire agreement

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DrawingHub regarding the Site.
